It is important not to speak with the other side of the dispute prior to contacting our office. If you have discussed the matter with them already, be sure to accurately write down what was said. Sometimes the other side of a dispute will record the conversation and will ask questions designed to make it harder for you to be able to protect your rights later if the matter can not be resolved. It is best to let our office handle the discussions to make sure only the information that the other side is entitled to receive is provided and no improper questioning takes place.
In many transactions involving consumers, the customer is forced to sign a document that requires a dispute be presented to arbitration. Arbitration is almost always a bad way to resolve a dispute from the consumer's perspective. The arbitration system requires the arbitration be performed only by certain organizations approved by the contractor, insurance company or business. These organizations usually favor the business and do not support the consumer. There are ways to avoid having your case heard by these biased arbitration panels. This will almost certainly require the services of an attorney who has direct experience with this issue.
